These Terms and Conditions (“Agreement”) govern your use of The Land Portal services provided by The Land Portal LLC, including data services, mapping software, and skip tracing services. By accessing or using the services, you agree to comply with these terms. If you do not agree with these terms, you must not use the services.

2. Subscription Plans and Billing
Billing Cycles and Payments:
- Monthly Billing: Payments are due on the same day each month. For example, the Premium plan costs $29.95/month and the Platinum plan costs $59.95/month, both billed monthly.
- Annual Billing: Users opting for annual billing will be charged for 12 months upfront. For example, the Premium plan costs $254.50/year and the Platinum plan costs $509.50/year. No free trial is offered on the annual plan.
- Automatic Renewal: Annual plans will automatically renew for another 12 months at the same rate unless canceled prior to the renewal date. Users will be notified of the renewal before charges are applied. The user’s credit card or payment method will be charged for the subsequent 12-month period.
- Unlimited Pro Plan: This plan is priced at $497/month for bulk data credits (20,000/month), and payment is due monthly. The annual subscription is $5,500, billed upfront for the first 12 months. There is a 3-month minimum commitment for the month-to-month option. Users will be billed monthly after the first 3 months, and cancellation is not allowed within the initial 3 months. After 12 months, the subscription will automatically renew for another 12 months at the same rate unless canceled before the renewal date. The user will be charged for the subsequent 12-month period, and the subscription will continue on an annual cycle unless canceled.
- Upgrades and Proration: If a user decides to upgrade from one plan to another, we will prorate the difference between the current and upgraded plans, calculating the amount due based on the time left in the current billing cycle.

4. Intellectual Property
- Ownership: The Land Portal LLC retains full ownership of all content, software, and data provided on the platform. This includes, but is not limited to, all mapping tools, skip tracing data, land filtering options, and other proprietary services. All intellectual property rights, including copyrights, trademarks, and patents, are owned solely by The Land Portal LLC.
- License: Users are granted a non-exclusive, non-transferable license to access and use the data and software provided by The Land Portal for personal or business purposes, in accordance with these terms. This license is revocable at any time, without prior notice, for any breach of these terms.
- Prohibited Activities: Users are prohibited from copying, redistributing, or reselling any part of the platform’s data, software, or services. Any attempt to reverse-engineer, scrape, or extract data from the platform is a violation of these terms and may result in immediate termination of access to the services. Users also agree not to use the platform to build any competitive or similar product or service.
5. Accuracy of Information
- Data Accuracy and Disclaimers: While we strive to provide the most accurate and reliable data possible, The Land Portal LLC does not guarantee the accuracy or completeness of the data, as it is sourced from various third-party providers. Users acknowledge that data discrepancies may exist and that The Land Portal is not liable for any errors or omissions in the information provided.
- No Warranty: The data, services, and software are provided “as is” without any warranties, express or implied, regarding accuracy, reliability, or suitability for any particular purpose. The Land Portal LLC disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
6. Service Interruptions and Maintenance
- The Land Portal LLC reserves the right to perform maintenance on its platform at any time. Maintenance typically occurs during low-traffic periods, such as overnight EST, to minimize disruption to users.
- We strive to provide continuous service, but users acknowledge that occasional interruptions may occur. The Land Portal LLC is not liable for any downtime, interruptions, or disruptions caused by such maintenance, force majeure events, or other unforeseen circumstances.
- Force Majeure: The Land Portal LLC will not be held liable for any failure or delay in performance due to events outside of its reasonable control, including but not limited to natural disasters, government actions, acts of terrorism, technical failures, or labor disputes.
7. Privacy and Data Protection
- Data Collection: The Land Portal LLC collects various types of information from users, including personal and payment information, user activity, and data related to usage of our platform and services. This information is used to operate, maintain, and improve our services.
- Data Security: We implement industry-standard security measures to protect user data, but users are also responsible for maintaining the confidentiality of their account and password details. Users should notify The Land Portal LLC immediately in case of unauthorized access to their account.
- Data Sharing: We do not broker or sell user data to third parties. Any data shared will be for internal business purposes only or as required by law. By using our services, users consent to the collection and processing of their personal data as described in our privacy policy.
- Compliance with Data Protection Laws: We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA), where applicable.
8. User Responsibilities
- Account Security: Users are responsible for maintaining the confidentiality of their account credentials and for all activities under their account. Users must immediately notify The Land Portal LLC of any unauthorized use or security breach related to their account. The Land Portal LLC is not responsible for any damages or losses arising from a user’s failure to protect their account credentials.
- Acceptable Use: Users agree to use the platform solely for lawful purposes and in accordance with these terms. Absolutely no scraping, unauthorized access, or attempt to disrupt the normal operations of the platform is permitted. Users also agree not to use the platform to engage in any activity that could harm The Land Portal LLC or its users.
9. Amendments and Updates
- The Land Portal LLC reserves the right to modify, update, or amend these Terms and Conditions at any time. All changes will be posted on our website, and users are encouraged to review these terms regularly.
- Continued use of the services after any such changes constitutes acceptance of the new terms. If a user does not agree to the updated terms, they must discontinue using the platform. We will provide reasonable notice of material changes via email or in-app notification.
10. Dispute Resolution
- Any disputes arising from these terms and conditions will be resolved through binding arbitration, rather than through court litigation, except for claims that may be brought in small claims court. Arbitration will be conducted in accordance with the rules of the American Arbitration Association.
